Description: It is about purchasing medical devices, where large differences exist between the products/systems of different suppliers. The products have different application options and each have their own advantages and disadvantages. In general, a contracting authorityDienst lesser quality and more limited application possibilities of a product to accept, as a cheaper but less suitable product based on the award criterion as the best comes out in a tendering procedure. When purchasing a medical device such as conventionalAdhesive material, whereby the choice of the product/system of a specific entrepreneur has a direct influence on the quality and safety of care and the patient's chance of survival, this is different. In addition, this assignment cannot be carried out by multiple supplier because of the fact thatOnly Johnson & Johnson can offer a total portfolio triclosan coated adhesive materials. This allows the UMCG to rely on Article 2.32, paragraph 1, under b sub 2. Aw. This article describes that if no competition is possible for technical reasons, an exception to theTender obligation. Due to the combination of the required technical specifications (specific requirements as described), only Johnson & Johnson is able to do the need of the UMCGprovided.
