- Description: Maintenance and licenses of the DMS Corsa By BCT between Werkzaak and BCT, an agreement has been concluded in the past regarding the purchase of a license for the standard software of Corsa, the development of customized software on Corsa and the maintenance ofThis software. The intellectual property law (IP law) with regard to the standard software is based on BCT. The IP right with regard to the customized software is based on Werkzaak. It is stated that BCT as based on the IP right on its right (i.e., excluding exclusionFrom another party) is authorized to carry out maintenance on the standard software. Werkzaak dient zich ervan te vergewissen dat BCT exclusief bevoegd is met betrekking tot het onderhoud. Insofar as this is the case, it offers the provisions of Article 2.32 under b tendering law the possibilityTo apply a negotiation procedure without announcement (one-to-one assignment). This article stipulates: The contracting authority can apply the negotiation procedure without notice if: […] b. the public procurement for technical or artistic reasons or for reasons of protectionof exclusive rights can only be entrusted to a defined entrepreneur, [..] The term exclusive rights can in any case be understood to mean the exclusive rights under the intellectual property right, such as copyright and patent right.The condition to be able to appeal to this provision can be met. This makes it defensible that the assignment can be granted one-on-one to BCT on the basis of Article 2.32 Sub B Prensification Act. Because of the aforementioned reasons, the Rivierenland work case considers it defensible for theMaintenance and licenses of the DMS Corsa No tender is issued, it now publishes this voluntary transparency in accordance with the provisions of Article 4.16, paragraph1Procurement Act ....
